Terms & Conditions

By accessing, browsing, submitting quotes, registering an account on the Client Dashboard, deploying websites, or purchasing packages from B A C Web Development & Cloud Services ("B A C", "Company", "we", "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy (compliant with the DPDP Act 2023), Refund Policy, and applicable Service Level Agreements (SLA).

If you represent an entity or organization, you warrant that you have full legal authority to bind that entity to these Terms under the Indian Contract Act, 1872.

B A C provides professional web design, bespoke software engineering, cloud infrastructure orchestration, and automated hosting deployment platforms:

• Custom Quotation & Consultation: Custom project requirements submitted through our Price Calculator or Custom Package form require technical evaluation. The ₹20 initial booking/processing fee confirms genuine requests and is credited toward project invoices where applicable.
• Deliverables & Scope Verification: Final project deliverables, timeline milestones, staging environments, and production delivery are formalized in mutual technical scope specifications.
• Client Revisions: Standard packages include up to two (2) complimentary rounds of design/layout revisions prior to production launch. Additional modifications are billed at standard developer hourly rates.

Clients utilizing our high-speed managed hosting and automated EdgeRouter services agree to the following operational parameters:

• Pan-India Edge Infrastructure: Our edge routing network coordinates with 21 server location points across Indian hubs. Location selection in the Client Dashboard guides optimal internal edge placement while maintaining strict IP masking and origin privacy.
• Uptime & Maintenance Windows: While we target 99.98% platform reliability, scheduled routine maintenance may be performed with prior notice published on status.officialbac.in.
• Prohibited Content & Abuse: Clients shall not host or deploy malicious code, phishing portals, cryptocurrency mining scripts, gambling portals, unauthorized copyrighted material, or content in violation of the Information Technology (Intermediary Guidelines) Rules, 2021. Any violation results in immediate instance termination without refund.

All fees are quoted in Indian Rupees (₹ INR) unless explicitly stated otherwise.

• Payment Processing: Transactions are securely executed through certified payment processors (Razorpay). Clients agree to pay all applicable GST (Goods and Services Tax) charges as reflected on official invoices.
• Project Milestone Invoicing: Standard web development contracts operate on a 50% advance mobilization deposit and 50% upon final staging completion before source code handoff and production deployment.
• Late Payments: Invoices unpaid after 14 business days may result in temporary suspension of active staging containers and deployment pipelines.

1. Client Ownership: Upon receipt of full and final payment, complete proprietary ownership of custom application source code, custom visual designs, and database records created specifically for the client transfers entirely to the client.

2. B A C Core Infrastructure: Proprietary internal deployment scripts, EdgeRouter architecture, status monitoring daemons, and pre-existing code modules remain the exclusive intellectual property of B A C.

Both parties agree to comply with their respective statutory obligations under the Digital Personal Data Protection Act, 2023 of India.

When B A C processes digital personal data on behalf of a client within a hosting container or database, B A C acts as a Data Processor, while the client acts as the Data Fiduciary. The client warrants that it possesses all necessary lawful consents from its end-users to process and store data.

To the maximum extent permitted by applicable Indian law, B A C shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business interruption.

The total aggregate liability of B A C arising under any project agreement shall not exceed the total amount actually paid by the client to B A C for the specific service giving rise to the claim in the preceding three (3) months.

These Terms and any contractual agreements entered into with B A C shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India.

Any disputes, controversies, or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent Civil Courts in Ahmedabad, Gujarat, India.
